From July 1, 2025: Major Changes in Work Permit Procedures for Foreigners in Vietnam

According to the latest decision from the Ministry of Home Affairs, numerous administrative procedures in the fields of employment and occupational safety will be decentralized to provincial and commune-level People's Committees.

This reform not only facilitates smoother processes for businesses but also requires them to promptly update their knowledge of the new regulations to avoid violations and delays in document submission.

Key Changes You Need to Know

1. Decentralization of Work Permit Authority to Provincial Level
Previously, procedures such as applying for a work permit, renewing it, or applying for an exemption had to be submitted to the Ministry of Home Affairs. Starting from July 1, 2025, provincial People’s Committees will be the authorized agencies to directly handle these applications.

2. Mandatory Job Posting for Vietnamese Candidates First
Under the new regulations, before applying to employ a foreign worker, the employer must post the job vacancy for Vietnamese workers on the provincial People’s Committee’s official website for at least 15 days.

  • Salary
  • Required experience
  • Working time and location

Only after no suitable Vietnamese candidate is found can the employer submit a Foreign Labor Demand Explanation Report.

3. Permit Exemption Still Requires Notification

Even in cases where a work permit is not required, the employer must notify the provincial People’s Committee in the following situations:

  • Foreigners working for less than 3 months
  • Heads of international project representative offices
  • Technical experts handling emergency issues
  • Dependents of diplomatic mission members
  • Executives and experts working under 30 days, no more than 3 times per year

Notification timeline: At least 3 working days before the foreign worker begins employment.

4. New Forms and Processing Timelines
All application forms and procedures must now follow the Appendices of Decree 70/2023/NĐ-CP and the new Decision issued by the Ministry of Home Affairs.

Application processing times:

  • Foreign labor demand explanation: 10 working days
  • Work permit issuance: 5 working days
  • Confirmation of exemption from work permit: 5 working days
