Conditions for Extending a Work Permit
Required Documents for Work Permit Extension
a) A written assignment from the overseas employer sending the foreign worker to work for a limited time at the commercial presence in Vietnam, confirming that the foreign worker has been employed by the overseas employer for at least 12 consecutive months before working in Vietnam — applicable to intra-corporate transferees.
b) A written assignment from the employer along with the signed contract or agreement — applicable to foreign workers performing various types of economic, social, or contractual projects in Vietnam.
c) A service contract between the Vietnamese and foreign partner, plus proof that the foreign worker has been employed for at least 24 months by the foreign enterprise without a commercial presence in Vietnam — applicable to contractual service providers.
d) For foreign workers entering Vietnam to negotiate service provision, a written assignment from the service provider is required.
đ) A written assignment from the overseas employer sending the foreign worker to work in Vietnam for the intended position — applicable to transfers from foreign agencies, organizations, or enterprises to Vietnam (excluding intra-corporate transfers).
e) For foreign workers serving as Chairman of the Board of Directors or Board member of a joint-stock company, owner or member of a limited liability company with a capital contribution of less than VND 3 billion, proof of being a manager in accordance with regulations is required.
Procedure for Work Permit Extension
At least 05 days but no more than 45 days before the expiration of the current Work Permit, the employer must submit the application for Work Permit extension to the Ministry of Home Affairs (previously Ministry of Labor, Invalids and Social Affairs) or the Department of Home Affairs (previously Department of Labor, Invalids and Social Affairs) that issued the current Work Permit.
Within 05 working days from the date of receiving a complete application, the Ministry or Department of Home Affairs shall process the extension. If the extension is denied, a written response stating the reason must be provided.
For foreign workers under labor contracts: after the Work Permit is extended, the employer and the foreign worker must sign a written labor contract in accordance with Vietnamese labor law before the expected continued working date.
The employer must submit the signed labor contract to the competent authority that extended the Work Permit. The contract must be either the original or a certified copy.
Validity of the Extended Work Permit
A Work Permit may be extended only once, for a maximum period of 02 years.
